“I Hate Tim Tebow”

I Twittered those words last night, sitting in a rain-soaked Mile High Stadium finally fed up with the 18th series of boo’s coming down and the 10th chants of Tebow that started no sooner than halfway through the 2nd quarter of the first game of the 2011 season. So I posted the following to Twitter:

I hate Tim Tebow – and it’s because of all you jackasses at this game that chant his name. What about him drives you to boo your own team?

So I rang that bell – and I can’t un-ring it. Since then I’ve engaged in some Twitter discussion with Tebow supporters – some of them friends & family – about my comments and what spurred them. While I can’t put this toothpaste back in the tube, I feel like I need more than 140 characters to explain what I said, and why I wrote what I did:

“I Hate* Tim Tebow**”

* ”Hate” is a strong word, but it’s important to understand Sports Hate vs. Real Hate. Because of the affiliation nature of sports, you have the ability to hate a player for what they do on the field, or you hate that they’re on a team that you rival. You don’t hate the person personally, or want anything bad to happen to them or their family – you just don’t want to see them do great in sports at that moment.

** In the case of Tim Tebow, I don’t have a problem with Tim as a player or as a guy. He’s a charismatic athlete who has found success in a conventional game through unconventional ways – it’s easy to understand why people gravitate to him and root passionately for him. At the same time, Tebow has (unintentionally) bred an aura of mal-content and distrust amongst Broncos fans against the coaches, management and team in general. Over the years as we have watched the team suffer some fallbacks, it seems that fandom has taken a turn for the worse. Once unconditional supporters, Broncos fans have now become fickle, ready to turn on their team with a series of boo’s after every bad play.

This is nails on a chalk-board for me. There are very few exceptions, but generally you should never boo your own team at home! Last night when the game started, I commented to my wife that there was a great sense of energy in the stadium that hasn’t been felt for some time – that all lasted all of 1.5 quarters, when the boo’s rang down amongst the stands after an interception was thrown. A steady stream of boo’s persisted for the rest of the game, much like the rain that fell throughout the night. The boo’s then degenerated into chants of “Te-bow, Te-bow” throughout the third and fourth quarter. In the storied South Stands, fans started to turn on each other, with one fan profanely ripping into a guy for saying Orton should get the benefit of the doubt.

I hate to say it, but last night the Raider fans showed more class towards their team. It was no surprise that they egged on Broncos fans that chanted for Tebow. Why not root for the continued fracturing of fanbase of your rival?

I realize Tebow didn’t ask for this (at least not directly – Tebow has no shortage of endorsements, public appearances, and has written memoires at the age of 23). Tebow didn’t ask to be drafted in the first round. Tebow didn’t ask to play for John Fox and John Elway. Tebow didn’t ask to sit on the bench while his team is struggling – I get all that. What I don’t think Tebow fans get though is that putting him in isn’t going to solve all of your problems. John Fox and his staff have forgotten more about football than most fans know. As fans we have a right to second-guess the coaches, but in the first game in the first season: the coaches deserve the benefit of the doubt. They feel Tebow isn’t the right guy to play in this situation, we should accept that. If you don’t agree with that – fine, then don’t cheer Orton – but to boo the guys that put their health on the line to ultimately entertain you – that’s classless.

The problem I have with Tebow is that his presence is turning a segment of Broncos fans into Tebow fans, who couldn’t care less about the state of the team. All that matters to them is to see their guy play. Nevermind the other 44 players on the team. Nevermind that Tebow is currently the 3rd-string QB after a training camp where he seems to have regressed in his performance.

Orton shares in some of the blame for last night’s loss, but there’s plenty of it to go around. Orton didn’t make the running backs anemic in their 38 yard performance. Orton didn’t commit 6 holding penalties on the offensive line. Orton didn’t drop passes. Orton didn’t let the Raiders rush for nearly 200 years last night. Tebow is not going to make all of this better.

I realize that I’m extremely fortunate to be able to attend home games, and that there are people far more deserving than I that don’t get to go, but it’s not fun going to the games anymore – not because we’re losing, but because being completely infatuated with a single player, the fans have lost sight in what it means to support their team.

When Digsby came out in 2008, I was a lost refuge in the land of IM. I broke up with Trillian, which at the time was experiencing painfully slow development during a slow Alpha Testing period. At the time I was in the IM dessert known as Pidgin: a great IM alternative, but ugly interface. Digsby was a breath of a fresh air, combing the ability to keep myself updated on social networks, emails and of course instant messaging. I was an avid fan of Digsby from the start, turning friends and family into users of the app. Over the years, Digsby had its fair share of stumbles, the guys developing Digsby had made a great product and had a great relationship with their user community.

Unfortunately, like that Indie band that you’ve passionately followed, they became big and were never quite the same. In Digsby’s case, it was acquired by a company called Tagged back in April. In their blog post, Digsby claimed they were going to continue to support Digsby and they were going to determine the long-term plans for Digsby. Over three months later, with virtually no communication from their blog, in their forum or through their Twitter account – let alone any changes to their app – the long-term plans are all too apparent: there are none!

To be fair, they’ve made small bug-fixes whenever MSN changed their protocols, but the straw that’s breaking my fact is that on July 1st Twitter changed their authentication model, which broke the way Direct Messages are retrieved. I’ve submitted a bug and scoured the forums to no avail. In fact, the only topic that is getting traction on the forum is the “Digsby Dead” topic, where other fans are concluding that Digsby has in fact died.

So Rest In Peace Digsby. You were a great product which I loved, but I’m not going to continue to use a product which is no longer supported. At least there’s on take-away: you guys gave Trillian a swift kick in the pants and now they’re passing you by. In related news: I am now using Trillian again.

Please, prove me wrong. I’d be happy to come back.

At this point you’ve probably heard of Google+, their latest foray into Facebook’s territory. "Heard" is probably the key word, because so far very few people have even seen it. The invites have been slim, and after more than a week of being unmasked, I only personally know one person who has received an invite.

As expected though, all of the tech journalists and pundits have received their invites, and since there have been numerous articles, videos and podcasts touting the new service. People have devoted their entire shows to covering the new features and whether Google is a game-changer in the social networking space. I don’t blame the tech journalists for covering this and discussing this – it’s their job.

At the same time, I think that many of the pundits are failing to notice the disparity between themselves and the people they are supposed to inform. I understand the intention of wanting to give people a good perspective of Google+, but hearing these people get caught up in the excitement is only serving to remind me that the pundits are the cool kids, and we are not. They’re inside raving about the meal, while the rest of us are standing outside with our noses pressed against the glass.

Maybe Google may be thinking they’re carefully cranking the "hype" dials, giving the loudest voices the first access, but Google is walking a thin line right now. While people now seem excited about getting a glimpse, their excitement may turn into resentment as people’s patience wears thin. One can only go so long only hearing about something without any chance of a glimpse.

My hope is one of two things happens: Google starts to open the flood gates on invites, so more of us "common folk" can starts to play with Plus, or that the pundits stop drinking the Google Kool-Aid and let the hype calm down. Hopefully all of you that want invites will get them soon!

Update: It looks like Google is starting to open up the invite process. I was actually able to get in this morning. Who else is in?

It seems that every tech media outlet is frothing at the mouth this morning over Steve Jobs posting an open letter about Flash on the iPhone platforms. I would be remiss if I didn’t share some of my immediate thoughts on what I read.

First off, outside of being a normal Smartphone consumer, I really have no dog in this fight. I’ve written some things in Flash before, but truth be told I try to avoid this platform because of the inherent usability and accessibility issues that surround it. However, Flash has definitely found it’s niche in media: both in video players, as well as an audio player. I currently use Flash music players on Greenfoot‘s site, and there still isn’t really an open standards answer out there for music players.

I also do find it funny that Apple and Adobe are feuding, given their extensive history together. I remember when design products like Photoshop were only available on the Mac, and what a big deal it was to have a Windows version. Now, according to Steve Jobs, half of the Creative Suite tools are now on Windows. I seriously believe that if Adobe never bought Macromedia in 2005, these companies would still be BFF’s.

Also if you know me, you know that I do have a disposition towards Apple – I cannot deny that. My difficulty with Apple is that they employ many monopolistic practices and actions, yet somehow get the tech media to view them through some rose-colored glasses. They definitely know how to work the hype machine, and as someone who generally doesn’t like overzealous hype, it really bothers me. However, I think it’s important to tell you where I sit before I talk about where I stand.

Reading through the letter, there are a few things that stand out to me:

First, there’s “Open”.

Oh this is great, we’re going to get a lecture on Adobe’s proprietary from Apple, a company that wont’ let you install their OS on any device they don’t personally manufacture, while also employing a completely locked-down mobile platform where they are the sole gate keepers to what is allowed on that phone. Thanks pot, but I know the kettle is black.

Apple has many proprietary products too. Though the operating system for the iPhone, iPod and iPad is proprietary, we strongly believe that all standards pertaining to the web should be open. Rather than use Flash, Apple has adopted HTML5, CSS and JavaScript – all open standards

Great, we’re glad you’re adopting HTML5, but at the heart of the matter is the fact that HTML5 still isn’t widely adopted on most browsers. Firefox doesn’t currently support most aspects of it, while Internet Explorer has little support for it. Whether or not the two major browsers should now be supporting it is debatable, but the fact is that the majority of the web still doesn’t have access to HTML5. Apple is very forward-thinking, but you need to come back to the present on this.

WebKit has been widely adopted. Google uses it for Android’s browser, Palm uses it, Nokia uses it, and RIM (Blackberry) has announced they will use it too. Almost every smartphone web browser other than Microsoft’s uses WebKit. By making its WebKit technology open, Apple has set the standard for mobile web browsers.

That’s great, but there’s a difference between the mobile web and the mainstream web, and the majority of the Internet still consumes the mainstream web through desktop browsers.

Adobe has repeatedly said that Apple mobile devices cannot access “the full web” because 75% of video on the web is in Flash. What they don’t say is that almost all this video is also available in a more modern format, H.264, and viewable on iPhones, iPods and iPads. YouTube, with an estimated 40% of the web’s video, shines in an app bundled on all Apple mobile devices, with the iPad offering perhaps the best YouTube discovery and viewing experience ever. Add to this video from Vimeo, Netflix, Facebook, ABC, CBS, CNN, MSNBC, Fox News, ESPN, NPR, Time, The New York Times, The Wall Street Journal, Sports Illustrated, People, National Geographic, and many, many others. iPhone, iPod and iPad users aren’t missing much video.

This is a little ingenuous. He’s right, much of the video is encoded in H.264, but much of today’s availability of H.264 is due to Apple strong-arming content providers into making this available. iPhones are hot right now, and everyone wants their content to be made available for Mobile Devices. Apple’s resistance to Flash has forced YouTube and other providers to go through this route. I took felt the above statement conveniently forgot this pandering, and is taking a “what a coincidence!” approach.

However, we’re talking video here. What about audio? Aside from using some of the major streaming services, people who visit bands web sites typically haven no way to consume audio streaming from web sites. There may be some standards conforming to video, but audio streaming still has a ways to go.

Another Adobe claim is that Apple devices cannot play Flash games. This is true. Fortunately, there are over 50,000 games and entertainment titles on the App Store, and many of them are free. There are more games and entertainment titles available for iPhone, iPod and iPad than for any other platform in the world.

I love this, he completely sidestepped the issue and cast his reality-distortion-field so that you feel comfortable in their Walled Garden. I have some fun games on my Droid, but you’re conceding that rather than have a ubiquitous game across multiple platforms, the answer is to splinter the game developer community.

Symantec recently highlighted Flash for having one of the worst security records in 2009. We also know first hand that Flash is the number one reason Macs crash. We have been working with Adobe to fix these problems, but they have persisted for several years now. We don’t want to reduce the reliability and security of our iPhones, iPods and iPads by adding Flash.

That may be true for Macs, but for Windows platforms Flash has been pretty stable. The instability of Flash in Macs is because Apple has held tight reins in who can access their video hardware acceleration. Apple is dragging it’s feet on Adobe’s coattails, then has the gall to complain about performance. I would surmise that Adobe’s problem with Flash on Macs is really Apple’s problem.

Adobe publicly said that Flash would ship on a smartphone in early 2009, then the second half of 2009, then the first half of 2010, and now they say the second half of 2010. We think it will eventually ship, but we’re glad we didn’t hold our breath. Who knows how it will perform?

Adobe definitely has been slow on their mobile strategy, it’s true, but Apple is hardly an innocent bystander in all of this.

Fourth, there’s battery life.

If Apple wasn’t so arrogant in their hardware by not allowing removable/spare batteries, this wouldn’t be an issue. At this point people have accepted the trade off, understanding that if they’re going to have a snazzy phone, they’re going to need to recharge it at least once per day. I ware down the battery on my Droid all the time, but I also have a spare battery for those days that I can’t easily recharge it. Apple has created their own problem by not allowing removable batteries in their devices.

Apple’s revolutionary multi-touch interface doesn’t use a mouse, and there is no concept of a rollover. Most Flash websites will need to be rewritten to support touch-based devices. If developers need to rewrite their Flash websites, why not use modern technologies like HTML5, CSS and JavaScript? Even if iPhones, iPods and iPads ran Flash, it would not solve the problem that most Flash websites need to be rewritten to support touch-based devices.

As a developer, I can tell you that it’s easier to enhance something you’ve already written than completely re-write it on another platform. Also the “modern technologies” point is moot because (like it or not) the reality is that the majority of the web can’t use HTML5. These are not “modern technologies”, they’re bleeding edge, and for many the risk still outweighs the reward.

Sixth, the most important reason. This becomes even worse if the third party is supplying a cross platform development tool. The third party may not adopt enhancements from one platform unless they are available on all of their supported platforms. Hence developers only have access to the lowest common denominator set of features. Again, we cannot accept an outcome where developers are blocked from using our innovations and enhancements because they are not available on our competitor’s platforms.

Wait, a few paragraphs up weren’t you telling me that I should port my Flash app to HTML5? You’re advocating HTML5, which isn’t conforming to the lowest common denominator. Plus, I’m not really sure why you see Adobe as a competitor in this, aren’t they a consumer and a partner of your technologies? This is the problem when you blur the line between owning the platform, and being the sole gatekeepers into the platform. There is where comparisons to a certain board game involving Boardwalks come into play.

Our motivation is simple – we want to provide the most advanced and innovative platform to our developers, and we want them to stand directly on the shoulders of this platform and create the best apps the world has ever seen. We want to continually enhance the platform so developers can create even more amazing, powerful, fun and useful applications. Everyone wins – we sell more devices because we have the best apps, developers reach a wider and wider audience and customer base, and users are continually delighted by the best and broadest selection of apps on any platform.

I don’t understand how these goals can’t be accomplished without bashing Adobe. If people want to have the best experience, then yes, use your native tools. If an App sucks because it’s a crappy port, it’s the App’s fault. I think you need to give the intelligence of your customers a little credit here. If an App sucks on my Droid, I delete it and avoid that App, I don’t chuck my phone out the window.

Flash was created during the PC era – for PCs and mice. Flash is a successful business for Adobe, and we can understand why they want to push it beyond PCs. But the mobile era is about low power devices, touch interfaces and open web standards – all areas where Flash falls short.

So rather than let Adobe evolve their technology into the next platform, you’re just going to cut them off at the knees and dictate their business for them through your strong-arm tactics. Very competitive.

This is definitely a complicated issue, and I in no way am I an Adobe apologist, but this isn’t as black & white as Steve Jobs would like you to believe.

I never thought I’d be writing a blog post where I would be protesting the removal of Hitler videos, but stranger things have happened.

I’m actually angry that Constantin Film, producer of Downfall (a great German movie that depicts Hitler’s madness during the last hours of his life – worth seeing if you like history) has idiotically ordered the takedown of all of the parody videos that have basically been free advertising for them.

I’ve actually referenced these parodies in previous posts – recently with Conan and Michael Jackson. You can’t view them anymore though, because YouTube had to comply with the DMCA takedown notices. See the story here.

This is stupid on so many levels. First off, this should be Fair Use under Parody – YouTube admits as much and is encouraging users to fight back on these takedown. It’s stupid that YouTube can’t fight on your behalf, but they have no choice but to comply with the studio – thank you DMCA! Secondly, these videos have been free advertising for your movie. I can’t tell you how many people have watched these parodies and then asked “What is this movie, I should actually check it out”. Lastly, the Movie’s Own Director loves the parodies, saying “you can’t get a better compliment as a director”.

Of course, this situation wouldn’t be complete, if it didn’t have its own parody-a pretty classic one at that (warning: offensive language).

These videos will be back up soon enough. As much as these studios would like think they control all of this, you can’t stop fair use.

Just a quick hit: I’m really excited to go see Muse on Tuesday, but needed to figure out when we should probably head down to Broomfield. I figured I would go check out the show listing on Muse’s web site, but can you look at this page and tell me what time the show starts?

Don’t get me wrong, this is a really cool design. Whoever’s doing their web work has some really cool things going on, but at what point was it a good idea to not list the start time?!? I thought this maybe was a fluke, but sure enough none of the other pages list their show times as well.

Normally I would go home and look at my tickets, but these tickets were using this “Flash Seat” where I simply wave my credit card that I used, and we seemingly have seats – pretty hard to print the start time on that.

It’s not like I’m squeezing the Muse concert between activities, but you’d think at some point it would be a good idea to tell people when they should make their way down.

Ah, Social Media. Every company wants to get in on the action, using tools like Twitter and Facebook, finding new ways to engage customers and drum up interest for their company. Some companies do it well, and for others: their good intentions blow up in their faces. I talked about Motorola’s mismanagement of their Facebook presence, the Denver-metro area Qdoba also now has an unfortunate Facebook story to tell.

Last weekend I got ping’d by a friend on Facebook, who was taking part in a contest put on by Qdoba with the prize of a year’s supply of burritos. In order to win, Qdoba wanted you to get your friends to “Fan” them on Facebook, then write their name and Qdoba Card # on their wall. On paper this seems like a great way to build Facebook currency (friends/fans) and drum up buzz for your company.

Introduce the chaotic variable known as the Internet into the equation, and your contest is now FUBAR’d. While my friend was lobbying people through his Facebook contacts, his two main competitors were packing their own ammunition. The first is allegedly a “Professional Contest-Player”, and quickly rallied her other “Professional” colleagues on the various contest and giveaway sites (I Googled her name + her card number and got these search results:

The other competitor, has some association with ThePensBlog and his plea for help got picked up there, rallying their army and ultimately bringing him the victory. However, along the way, the blog got wind about the “Professional Contest-Player” and lobbied some attacks in the form of: “Do you hate this bitch’s face already? Want to bring pain to her ego? After the jump, a call to arms.” Of course, when you take prideful Pittsburgh fans and pour gasoline on your story, your commenters are going to light the think of fire with hate and vitriol. Say what you will about “Professionals”, no one deserves the mud this poor girl was slung.

Qdoba’s once great contest idea was fast becoming a platform for slander, so they had no choice, but to post the following on their wall:

Of course, you can comment on anyone’s fan page, so the people who were perpetrating this slander were now acting like their candidate was the victim in all of this, and made threats about what would happen if Qdoba didn’t award the contest to him. Ultimately Qdoba made the most of their bad situation: gave the prize, then awarded the runners up with generous prizes of their own. Still the proponents of the winner are still whining – nothing like looking a gift-burrito in the mouth.

To be fair to the guy who won, he didn’t make any public disparaging comments about the other contestants. At the same time, there is definitely an association of guilt, and I’ve always found it fair to judge people based on where/who they build their community. Responsibility should be taken up, especially since the guy is now 52 burritos richer.

Ultimately I feel bad for Qdoba. We’re all still trying to navigate this social media river, and when you have something like this blow up in your face it doesn’t encourage you to get back on the boat. They ended up giving away nearly 2 years worth of burritos, and all they have to show for it is a page full of slander and intimidation.

Companies like Qdoba, please don’t lose heart in this. I think if they were go back and do it again, they could have made one tweak to the rules and avoided much of this mess. Simply add a rule to the effect of “No promotion or lobbying outside of Facebook is allowed. We will be running searches on the leaders and if we find any external lobbying, you will be disqualified.” I used Google to get that above screen shot, and discovered the blog post by doing a similar search on the winner. That way you keep your promotional efforts within Facebook (which is what you want), and ensure that your winners are using the same platform to campaign. People may try the winner’s excuse of “I can’t control what people do”, but let’s be honest: if I wanted to win that badly I’d make damn sure people kept it as word-of-mouth.

So sorry Qdoba, I still think you’re great. Better luck next time!

As you know I’m a Droid user, and for the most part am happy with my device. Since the announcement of Android 2.1, us Droid users have been anxiously awaiting an update to our devices. Google’s anointed phone, the Nexus One received the update back in February, and the Droid users have been anxiously awaiting news on when we will be updated.

Out of the gate, Motorola said all the right things, issuing a post on their Facebook page on February 9th that the update was coming “this week”. That was then met with refuting news a few days later on their forum. After that. silence. Motorola remained completely mum on the issue, both of their Facebook page, on the forum, through news sources – there was no word about when the update would happen. Motorola customers, including myself, have been complaining on their Facebook page about the lack of details. I actually uploaded my own subtle protest on their “Motopic Monday” feature on Facebook. Finally Motorola shares the news: the upgrade will be rolled out on Thursday to a few test users, then will be going out to all customers over the new few days.

Thursday comes. and goes. It turns out that Motorola delayed pushing out the update again, reported by Engadget. Of course, Motorola’s own Facebook page has been indirect and mum on the issue. Motorola never actually comes out and says the update has been delayed, yet they allude to it with their last two posts:

Thanks for your continued patience. We aim to answer each and every question; if your post isn’t answered immediately, please know that we’re looking into your question so that we can provide the most up-to-date information as possible.

Hi Everyone – We are looking into this new update and will definitely share with you what we find. Please patient with us! Thank you!

Rightfully so, Motorola’s customers have been hammering their Facebook page non-stop with complaints and comments. Motorola has just continued to botch this situation up – I can’t imagine how else they can screw this up from a PR front.

Motorola, I understand these technical these technical issues come up and it’s completely fine – but be direct and transparent when you’re communicating this! This business of putting out a statement, then letting weeks go by without any word – is completely unacceptable. It’s great they’re using Facebook as a platform to put out this information, but by not following it up with any direct announcement or posts about the problems is only confusing people more. Also when they try to be coy with the mistake with “How embarrassing! We jumped the gun” but then offer no additional information is only infuriating. I’d much rather appreciate “We apologize, but we mistakenly communicated the wrong date. Please look for an announcement early next week” – then actually follow up like you promised!

We’ll see how long it takes for the Motorola & Verizon to finally get their stuff together and actually be direct with their customers – it’s the least they could do.

I was playing Madden on my X-box the other day (but let’s face it, that’s all I ever do with my X-box from August to Christmas), when after choosing my play I saw the following on my pre-snap screen.

Wow EA, talk about ballsy. Is it not enough that Madden is the most popular sports franchise of all time, and that suckers like me continue to shell out $60 each season for the equivalence of roster updates? Now you’ve resorted to showing me ads on the game that I paid for that obstruct the game experience? Thanks jerks!

Look, I’m fine with you inserting ads into the game where it’s realistically done so. I’ve come to accept the “Sprint Recap”, and the “Snickers Chompion Coin Toss” for two reasons: 1) It doesn’t interfere with my actual game play; 2) Because this is done during regular NFL games and is a sad reflection of the level of sponsorship in the NFL. The league is pretty bad when it comes to in-game ads, but I don’t see ads streaming across the jumbotron before the QB is going to snap the ball.

Seriously EA? I understand you’re not a charity, but there has to be better ways to get revenue than this. Quit killing your golden goose, or before you know it it’ll stop laying eggs.

(From the “Better Late Than Never”) file: On the heels of the MPAA’s Indoctrination Piece on movie piracy, the movie industry again demonstrated their complete lack of competence in adapting to changing business models by screwing their customers. Last week, a story came out in The Consumerist where the movie industry wants to stimulate purchases of new release by having rental companies like Netflix delay renting of new releases for a month.

I love their thinking here: “People don’t want to pay an arm & a leg to see the movie in a theater, so let’s see if they’ll pay an arm & a leg to buy that movie they’ve never seen before.” I can only speak from experience, but I have never bought a new release movie if I haven’t seen it before in the theaters.

What makes things worse is that Netflix looks like it’s going tog with this. Mashable quoted their CEO, “if we can agree on low enough pricing for delayed rental, it could potentially increase profits for everyone”.

Look, I know they think they’re hemorrhaging money, but punishing your customers for wanting to see a new release is not the answer. You need to think outside of the box on this one. Make no mistake, pleasing customers is that last thing the movie industry is interested in. Nice business model. Then they wonder why people resort to piracy to view their content.

Watch this, and feel your blood boil. Watch as 60 Minutes, a supposed beacon of broadcast journalistic integrity, is spoon-fed propaganda from the MPAA, and eats it right up.

Let me make one thing clear: I don’t support movie piracy. At the same time, I can’t sit here and let the MPAA spread misinformation and scare tactics, painting everyone with a broad brush of evil.

I love how Leslie Stahl eats up all of the information – my favorite part is the look of disgust at 2:50 when she repeats “In the diaper bag” – without offering any kind of challenge or exploration in the truth of their claims. Instead, she just lets them go on and equate people who film movies in theaters to drug cartels, human traffickers and child prostitution.

I understand that there is a valid point in damage being done the counterfeit DVD circles, but 60 MInutes let the MPAA completely blur the line between them and the kids who download bit-torrented movies on the Internet. Furthermore, Stahl allows the MPAA to tarnish the US citizens with their broad brush, yet conveniently forgetting about the rampant piracy that is going on in Asia – specifically China – where they’re making money hand-over-fist from piracy. It makes sense that DVD counterfeits may cost them money, but where’s the direct linkage with bit-torrent? Still, the MPAA goes for their low-hanging fruit – the “gee-whiz computer technology”.

In the piece the MPAA allege that their industry is robbed of $6 billion annually by piracy – yet they base this on the false pretense that everyone that downloaded their movie had the original intention of seeing it in the theater, or purchasing the $25 DVD. That’s simply not true. According to the MPAA, the people downloading these movies must be doing it because they’re evil jerks who want to rob the “little people” of the movie industry blind. There can’t possibly be another side to this: the fact that people want to consume this media in different ways – that some people actually don’t want to go sit in a crowded theater with the talking and crying babies and $5 soda. In the piece they showed people being wanded and searched, as well as forced to turn in their cell phones, just so they can see a movie. Wow, when you treat your customers like criminals and give them cavity searches, who wouldn’t want to go to a theater? No way in hell am I going to give you my money, just so I can be treated like that.

It’s one thing if you’re providing a good alternative – like a same day digital release that I can watch in the comfort of my home theater with a cold beer in my hand – but the fact is that you’re blatantly ignoring the changing market conditions and instead just whine about the Internet. Where was Mark Cuban to talk about his same-day release and digital distribution ideas? 60 Minutes had no interest in providing any other views in this complex issue. Apparently movie downloading equates to drowning puppies: no one can have a differing view.

I love how they parade out Steven Soderbergh to say that he wishes the Internet was never invented. I’m sure you do Steven, because now people can warn other movie-goers about some of the crap that people call “movies” and expect people to shell out $8-12 to go see. Surely the fact studios green-light these sure-fire bombs (soon-to-be Avatar, anyone?) can’t be the reason no one sees these movies. no it’s all based on piracy.

Soderbergh says they’re losing money at an alarming rates, yet I think someone forgot to tell him that 2007 was a record-breaking year when it came to movie theater revenue. If I’m not mistaken, 2008 was an even better year for them. Apparently he still thinks they’re not being paid. Someone should tell him that the revenue you bring in, over the cost/budget for the picture (which I believe includes the salaries for “the little guys”) = profit for the studios.

Again, I’m not advocating piracy or making excuses for those who download movies – however is it too much to ask 60 Minutes to at least do some research before they parrot the MPAA’s talking points?

Just thought that my friends in Fort Collins would be interested in knowing that the City Council will be reviewing their controversial Occupancy Ordinance, that limits the amount of unrelated adults that can live in a rental home in the city. What makes this so controversial is that this law seems to target college student housing.

There was a really article in the Coloradoan that came out a few days ago, talking about a ‘lodge’ owned by a fraternity that was set up to house six members of the frat, as well as provide meeting space and non-alcoholic dinners. The house is located on Shields, right off of Laurel (which is right across the street from campus). The frat members attempted to be good neighbors by fixing up the yard, and attempted to work with city regulators to make the house fit within the zoning regulations. Yet neighbors still complained and now the city has threatened to fine the occupants $1000 per day members don’t move out.

This ordinance really frustrates me. While I sympathize with issues that single-family homeowners can face living next to inconsiderate students, what do people seriously expect when they buy a house that’s right next to campus? People can’t tout the benefits of living in a college town without having to accept that students are going to live in your town. It’s no different than complaining about an ethnic group living in your town but saying that you love the authentic <insert ethnic group> food.

Fort Collins is a big city, and if you want to live in a neighborhood with many families and few college students, there are plenty of great neighborhoods on the south side of town – away from campus. CSU is only going to continue to expand, which will only increase housing needs by the students. I realize that resident Michelle Haefele in the article doesn’t want her neighborhood “turned into a student ghetto”, but the last time I checked the CSU campus was there before she moved in. What did you expect when you bought a place in the neighborhood next to campus?

What bothers me most is that residents are so eager to blame college students for their declining property value. The behavior of some students is unacceptable, but what is also unacceptable is painting students with this broad brush by enforcing this ordinance. Let me ask you this, if you replaced the word “students” with an ethnic group or poverty class in the complaints, wouldn’t people have a problem with that?

Let’s see what City Council does Tuesday. I for one hope that people realize that they live in a college town, yet Fort Collins should be a big enough city to be able to accept everyone.

Just when you thought the content providers were started to get media distribution in an internet world, they’ve gone ahead and proven that they still have no idea what they’re doing. Yesterday at the B&C OnScreen Summit, News Corp’s Chase Carey alluded to the fact that Hulu is going to start charging viewers to watch their content starting in 2010.

Said Carey (via Broadcasting Cable):

“I think a free model is a very difficult way to capture the value of our content. I think what we need to do is deliver that content to consumers in a way where they will appreciate the value,” Carey said. “Hulu concurs with that, it needs to evolve to have a meaningful subscription model as part of its business.”

So never mind the consumers that visit the site to check out a new show – and use Hulu to catch up and go back to consuming their viewing through their traditional means. Never mind that Hulu does show pre-roll and regularly-placed ads that (anecdotally) get more of the viewers attention than a DVR’d show or a commercially-scheduled bathroom break when viewing on regular TV.

Never mind all that, I guess we don’t appreciate the value, as if it’s some great honor to view all of their shows. Look, last time I checked, we were the ones doing you a favor by watching your shows and viewing your ads. If you really want to generate more revenue, try throwing some more ads during the show and see if people will cry foul. My prediction is people would much rather take in an extra ad or two rather than fish for their credit card to watch last week’s episode of Family Guy.

I may be off base here, but I don’t really know anyone who uses Hulu as their primary viewing experience. Hulu is handy if you’re looking to catch up on back episodes, or something you missed, as well as viewing a classic clip from a show. I’m always going to prefer sitting on my comfortable couch and watching the flat screen over hunching over in my chair to look at my small laptop. If Hulu were to evolve to stream straight to TV’s (either through X-box or other set-top players) then maybe they could get away with charging. However, if Hulu starts charging with what they have today then they’re only going to regress their digital strategy further back.

Oh but don’t fear, Carey said they won’t put all of their content behind the walled garden:

Carey says that while throwing up a pay-wall around all content is not the answer, it doesn’t mean there wont be fees for some specially-created content and TV previews. Windows are just around the corner. [Broadcasting Cable]

Oh so you mean the crap I wouldn’t dream of wasting my time with will still be free? Sign me up! Thanks for continuing to prove that no matter how much the public connects the dots for you, you still manage to to completely screw up the picture.

Digsby is one of my essential apps that I virtually have running all the time. It’s really my window to the social world, through their Twitter & Facebook integration, as well as using it to manage my IM’s and emails. I want to say it’s my favorite program, but with their latest actions I feel like I did a little inside every time I fire up this program.

Digsby has always had one of the most evil installers, which sneakily offers your crapware that you don’t want, making it pretty hard to escape unscathed . Back in August they released a new version that stepped up the amount of crapware, but to make things worse they used your computer to “search the web” and do processing for other commercial companies. As if that wasn’t unbelievable enough, it was originally opt-out.

Lifehacker did a great job of chronicling the ordeal and rightfully ripping Digsby for their misdeeds. It’s worth a read. After enduring a PR firestorm, Digsby finally reneged on these restrictions, crying “mea culpa, mea maxima culpa” [see LifeHacker reaction]. In their blog post apologizing for (and defending) their actions Digsby proclaimed:

“We are still a young company that is trying to figure out our long term revenue models. At the end of the day, we need to keep the lights on and pay salaries so we can keep making Digsby even better .. The reason we decided to test these two revenue models is because they would allow us to accomplish this while keeping Digsby free and ad-free.” [Digsby Blog]

So I gave Digsby the benefit of the doubt, until I saw their Twitter post from last night:

Text DIGSBY to 41411 to be the first to know when there are updates and new releases!

So now they’re resorting to collecting cell phone numbers. I’m going to go out on a limb here, but I think that a social media & communication tool – rather than using said social media & communication methods to send their updates – is now going into left field and sending them through cell phones. How does this make sense? It only makes sense if you’re looking to graft ads at the end of these messages or perhaps even build them up for more sinister purposes (like renting them to another company).

I’m surprised there hasn’t been a backlash about this, but maybe it’s building up somewhere. I hope people see this as another one of their shady tactics and don’t buy into this crap. If there is a backlash I’m sure Digsby will apologize on their blog, saying they need to keep the lights on and will go doing good until they get their next “Pinky & the Brain” evil scheme to take over the world.

This is a disturbing and recurring pattern that is being displayed in some of these cutting edge Web 2.0 companies. Many deploy these slimy tactics and don’t see the problem with them until there is a backlash from their users. What this tells me is that their ethical compass isn’t pointing north and there doesn’t seem to be a pressing need to correct it.

I hate this because I think Digsby is a great app and I want them to succeed. I wish they simply would just go ad-supported and offer a modest price for a professional version. This has become an essential app every day and would gladly pay the price. but not like this.

Well the Rockies had a great run and blew everyone’s expectations – especially when you consider that back in the Spring Hurdle got fired because the team was so bad. I’ll be honest: Now that the Rockies are out of the Playoffs, my level of interest in MLB has significantly decreased. I did want to offer a thought, more-so an expansion of something I Twittered about last night before fatigue got the better of me.

The Rockies started playing at 8pm on a Sunday night, with the game ending well past midnight. We’re talking Mountain Time, never mind that we were playing Philly, an Eastern Time Zone team. Yet somehow baseball doesn’t see anything wrong with that.

Look, I’m not in so much denial about the Rockies’ stature that I believe the team warrants the major prime-time spot, and I am somewhat grateful that they re-scheduled the Rockies game to give Broncos fans the opportunity to watch.. but really an 8pm start time?!? Baseball can’t get away with the same tricks that basketball and hockey pull – their games are under 3 hours – and an 8pm start time doesn’t work for playoff baseball.

I’ve heard the detractors of my views (and debated with them on Twitter), that I am being selfish and am unwilling to sacrifice a little to support my home team. Perhaps they’re right, but consider this: Baseball has been in an arguable decline in popularity over the last few decades. Their die-hard fans aren’t getting any younger, and the only way to build your stature is by getting your product in front of as many potential fans – especially kids – as possible. It’s pretty hard to that when they’re all in bed.

I’ve stated previously that the NBA is pretty obnoxious about their playoff scheduling, but in the beginning they’re trying to fit in 8 games. Yet somehow baseball only has to manage 4 games and still finds a way to screw that scheduling up. Baseball is in a tough spot, but they need to start somewhere and accept a few things. For one, accept that you can’t avoid football and may just need to compete with it. If you’re going to play on a Sunday in the fall, you can’t avoid all of their games. Secondly, you need to make sure you’re on in the afternoons on weekends, the fact that you didn’t have a game scheduled on Saturday afternoon is nothing but a missed opportunity. Thirdly, if it’s too hard for you to take 2 games each night and alternate nights, then you maybe should accept the fact that the games will need to run on alternate channels. I know each sports feels their playoffs should run exclusively, but if you can’t manage the 4+ hours your game run then you need to do something.
